Terms & Conditions for Dignity Tours Scotland 

DIGNITY TOURS SCOTLAND — TERMS & CONDITIONS OF SERVICE

Effective Date: 2026
Contracting Party: Dignity Tours Scotland (“the Guide”)
Client: The individual or group making the booking (“the Client”)

1. Definitions

  • “Guide” refers to the self‑employed Scottish Tourist Guide providing services, operating as Dignity Tours Scotland.

  • “Client” refers to the individual or party booking the services.

  • “Tour” refers to any guiding or driver‑guiding service provided.

  • “Vehicle” refers to the Land Rover HSE used for driver‑guided tours.

  • “Day Tour” refers to a single‑day service.

  • “Multi‑Day Tour” refers to any tour lasting more than one day.

  • “Extended Hours” refers to any guiding time beyond nine hours in a single day.

2. Vehicle & Passenger Capacity

  • The Land Rover HSE seats up to 6 passengers on Day Tours.

  • For Multi‑Day Tours, capacity is limited to 4 passengers to allow adequate luggage space.

  • All passengers must comply with UK seatbelt law, which requires seatbelts to be worn at all times while the vehicle is in motion.

  • Smoking is strictly prohibited in any private hire vehicle under UK law.

  • The vehicle is insured under Hire & Reward insurance, as required for carrying passengers for financial gain.

3. Guiding Fees & Rates

  • Guiding fees vary depending on the length and nature of the tour.

  • A standard guiding day is up to nine hours, including breaks.

  • Extended Hours beyond nine hours may incur an additional charge of £50 per hour, subject to the Guide’s discretion and safety considerations.

  • All quotes and transactions are in £GBP.

  • Entrance fees to paid venues, attractions, events, ferries, meals, and accommodation are not included unless explicitly stated.

  • Tours are conducted in the English language.

4. Multi‑Day Tours: Accommodation & Meals

  • For Multi‑Day Tours, the Client is responsible for covering the Guide’s:

    • Overnight accommodation

    • Evening meal

  • A standard allowance of £150 per night applies.

  • In high‑demand areas or peak season (e.g., Isle of Skye), accommodation may reach £200 per night.

  • Due to UK insurance restrictions, the Guide cannot book guest accommodation.
    Guests must book their own accommodation in mutually agreed locations.

5. Itinerary Planning

  • If itinerary planning is required, a fee of £50 applies, covering approximately three hours of planning time.

  • The Client is responsible for booking all accommodation and any third‑party services unless otherwise agreed.

6. Ferries

  • Ferry travel is common in the Highlands and Islands.

  • Pre‑booked ferry costs (vehicle, driver‑guide, and passengers) will be added to the Client’s invoice.

  • Some ferry tickets can only be purchased at the port and must be paid directly by the Client.

  • Ferry services are subject to weather and timetable changes; the Guide is not liable for delays or cancellations.

7. Confirmation, Deposits & Payments

  • A 25% non‑refundable deposit is required to confirm any booking.

  • The remaining balance is due 28 days prior to the first day of the tour.

  • Bookings made within 28 days of the tour require full payment at the time of booking.

  • Guiding fees are typically payable in advance.

8. Cancellation Policy

If the Client cancels a confirmed booking, the following charges apply:

  • Two weeks or less 50% of total fee

  • One week or less 75% of total fee

  • 48 hours or less 100% of total fee

  • Any unrecoverable expenses (e.g., pre‑booked accommodation, tickets) will be charged to the Client.

  • Any recoverable costs will be refunded in full.

9. Travel Insurance

  • Clients are strongly advised to obtain suitable travel, medical, and cancellation insurance at the time of booking.

  • The Guide is not responsible for:

    • Third‑party closures or cancellations (e.g., ferries, cruise ships, venues)

    • Alternative accommodation required due to ferry or transport disruption

    • Loss, injury, accident, or damage to persons or personal property

The Guide will make reasonable efforts to assist with alternative arrangements where possible.

10. Safety, Driving & Legal Compliance

  • The Guide complies with all UK driving laws, including mandatory rest periods required of professional drivers.

  • Driving times in Scotland may differ significantly from online mapping estimates due to road conditions, weather, and rural infrastructure.

  • Safety is paramount; the Guide may decline to extend a touring day if conditions are unsafe or fatigue would breach legal requirements.

11. Seatbelt & Child Car Seat Policy (STGA‑Aligned)

11.1 Seatbelts

  • All passengers must wear seatbelts during all driving segments.

  • Failure to comply may result in the tour being paused until compliance is achieved.

  • No refunds will be issued for delays caused by non‑compliance.

11.2 Child Car Seats

  • Children must use a child car seat until they are 12 years old or 135 cm tall, whichever comes first.

  • Clients must inform the Guide at the time of booking if a child seat is required.

  • If the Guide provides a child seat, it will meet UK legal standards.

  • The Guide is not responsible for issues arising from incorrect information provided by the Client.

  • Failure to comply with child seat requirements may result in the Guide refusing to continue the tour.

11.3 Exceptions

  • UK law provides limited exceptions for unexpected, necessary, short journeys.

12. Children on Tours

  • Children under 17 years of age must be accompanied by a responsible adult at all times during the tour.

  • The Client is responsible for providing any legally required child car seat for all children who must use one under UK law.

  • In accordance with UK legislation, children must use an appropriate child car seat until they are 12 years old or 135 cm tall, whichever occurs first.

  • The Guide does not normally carry children requiring a child car seat unless the Client provides a compliant seat that meets UK safety standards.

  • The Guide reserves the right to refuse carriage if a required child seat is not provided, or if the seat supplied does not meet legal requirements.

  • No refunds or compensation will be issued for delays or cancellations resulting from non‑compliance with UK child‑restraint laws.

13. Weather

  • Scottish weather is highly changeable.

  • Clients should bring sturdy footwear and clothing suitable for all seasons, including waterproofs.

14. Liability

  • The Guide accepts no responsibility for:

    • Loss, damage, injury, or delays caused by third parties

    • Acts of nature, weather, or unforeseen circumstances

    • Personal belongings left in the vehicle

  • The Guide maintains full public liability insurance through STGA membership.

15. Professional Membership & Compliance

  • The Guide is a fully accredited Blue Badge Scottish Tourist Guide (STGA).

  • The Guide adheres to the STGA Code of Conduct and the SITOA Code of Ethics.

  • Vehicle insurance meets all legal requirements for carrying passengers for hire.

16. GDPR & Data Protection (UK GDPR)

16.1 Data Controller

Dignity Tours Scotland is the Data Controller for all personal data collected for the purposes of tour planning, communication, and service delivery.

16.2 Data Collected

Personal data may include:

  • Names, contact details, and addresses

  • Travel plans and itinerary information

  • Special requirements voluntarily disclosed by the Client

  • Payment‑related communication (no card details are stored)

16.3 Lawful Basis

Data is processed under:

  • Contractual necessity (to deliver the tour)

  • Legitimate interest (communication, safety, administration)

16.4 Data Retention

Personal data is retained only as long as necessary to fulfil the contract and meet legal obligations, after which it is securely deleted.

16.5 Data Sharing

Data is not shared with third parties except where required for:

  • Legal compliance

  • Insurance purposes

  • Professional association requirements (STGA/SITOA)

16.6 Client Rights

Clients have the right to:

  • Access their data

  • Request correction or deletion

  • Restrict or object to processing

  • Request data portability

17. Complaints & Dispute Resolution

Any concerns should be raised with the Guide as soon as possible so they may be addressed promptly.
